G. Fishta

Hi, and welcome from me as well. Thanks for the pages you created here. One problem: I had to delete the page Kanuni Parathâne by G. Fishta as it was a copyright violation, see also the discussion on Wikisource:Possible copyright violations/archive 4#Albanian authors and their work. Hi jkb, you're absolutely right, the law in Albania specifies 70 years after authors death^[1]. But Fishta is treated as public domain already. There was a law suite^[2] from the apparently copyright holder (Provinca Françeskane Shkodër) towards a publisher Frano Kulli (and his publishing house Gjergj Fishta) for not publishing Fishtas work in the original orthography, but not for publishing it, and Provinca Françeskane Shkodër won the case. Anyway I'm writing to Father Viktor Dema to ask for the permission to publish Fishta and other Franciscan authors to wikisource. I hope they will grant us the permission. Let us see. I'm a big Fishta's original orthography so it shouldn't fail on that. --Bresta 23:24, 15 July 2009 (UTC)

Thanks for reply. First it is necessary to note that the orthography is a secondary aspect only, the copyright concerns and protects the work as it is, and it can be set free for public domain by the copyright holder. (The transliteration in a new orthography in fact could create a new copyright for this orthography, but it is a difficult theme.) Secondly, If the copyright holder says he sets the documents into the public domain so it means public domain for all people and all purposes, not only the Wikisource. After I have seen the (very bad) google translation of the text you mention above I am not sure that the texts are in public domain yet. Thirdly, I moved the thext to Wikilivres where we use the Canadian copyright law with 50 years of protection, not 70 years. See Wikilivres and there Kanuni Parathâne. I started also to move some other texts there where they can stay for the time necessary before they will be moved back. I think this could be the best solution. Let me know. Other documents

Onother question are the documents like Drejtshkrimi Prishtinë 1964 etc. It seems to be a document of an orthographic commission. Normally such texts are copyrighted as well, one possible exeption could be that the commission is a state organisation. Can you tell me something about it? Thx, -jkb- 06:03, 16 July 2009 (UTC)

Well, yes they were all state organisation which don't exist anymore. There is a last one in the 70's from the Acadamy of Science in Albania which I didn't include, the only Organization that still exists.--Bresta 07:49, 16 July 2009 (UTC)
