An act
To determine the right of all persons to enjoy the facilities offered by public places and businesses in Puerto Rico; to provide for the cancellation of lease contracts, entered into with, and of grants, permits, and franchises issued to violators of this act by the insular and municipal governments and agencies thereof; to fix penalties for the violation hereof, and for other purposes.
Statement of Motives
The maintenance of the democratic principle established by the Declaration of Independence of the United States of America which states “We hold these truths to be self-evident that all men are created equal”, demands that the Legislature of Puerto Rico shall promulgate a statue expressly determining certain fundamental civil rights concerning the enjoyment by all persons in general of the facilities offered by public places and businesses in Puerto Rico, which will protect and secure equality of rights for all persons in Puerto Rico, and the maximum enjoyment of the benefits to be derived by the citizens or residents of Puerto Rico, from their condition as such, irrespective of differences of race and political or religious creed, in order thereby to promote and foster:
- The development and firm rooting in the people of Puerto Rico of the basic principles of a functional democracy;
- The destruction of Nazi-Fascist practices of racial hatreds and outrages directed against minority groups; and [ 405 ]
- The development of the best understanding among all the residents of Puerto Rico, and of the sense of national unity in our island.
Be it enacted by the Legislature of Puerto Rico:
Section 1.—(a) No person shall be denied in the Island of Puerto Rico any access, service and like treatment in public places and businesses and in the means of transportation because of any political, religious, race, or color question, or because of any other reason not applicable to all persons in general.
(b) The publication, circulation, or distribution of any order, notice or advertisement tending to prevent, prohibit, or discourage the patronage, or the attendance at public places and businesses and the means of transportation, because of question of politics, religion, race or color, shall be illegal.
Section 2.—Any person who shall deliberately or by false reports or by any subterfuge violate any of the provisions hereof, shall be guilty of a misdemeanor, and shall be punished by a fine of not less than twenty-five (25) nor more than one hundred (100) dollars, or by imprisonment in jail for a term of not more than one hundred (100), nor less than ten (10) days, or by both penalties in the discretion of the court.
Section 3.—When it shall be judicially determined that any person who is operating or doing business under a lease, cession, grant, or contract with the Government of Puerto Rico, the municipal government or any agency thereof, has more than once violated any of the provisions of this Act in the course of such business, such lease, cession, grant, or contract shall be immediately cancelled; Provided, That no similar lease, cession, grant, or contract shall be executed to such person by The People of Puerto Rico, a municipal government, or any agency thereof within the year following such cancellation.
Section 4.—It shall be the duty of the Attorney General of Puerto Rico, and the judges, district attorneys, and other officers of the courts of Puerto Rico, and of the members of police force of the island of Puerto Rico, to cooperate in making effective the enforcement and observance of this Act. If any member of the police force, marshal, deputy marshal, district attorney or judge shall obtain knowledge or information concerning any violation of the provisions of this Act, he shall investigate with diligence and seek to obtain [ 407 ]evidence of such violation, and shall swear out the proper complaint before competent authority against the persons guilty of such violation.
Section 5.—The Public Service Commission of Puerto Rico shall revoke any franchise or license issued pursuant to the Laws of Puerto Rico, whenever it shall be judicially determined that the person doing business under such franchise or license has violated more than once in the course of business, any of the provisions of this Act; Provided, That no similar franchise or license shall be issued to such person within the year following such revocation.
- Section 6.—Definitions.—
- ⑴ as used in this Act, the term “person” shall mean individual, corporation, association, business firm, business trust, or any incorporated organization; it shall include, further, any agency of the Government of Puerto Rico, and the officers, officials, agents, employees, and grantees thereof.
- ⑵ The phrases “place of public accommodation” and “public business” shall, among others, mean auditoriums, assembly rooms, and other places of public meeting; barber shops, cafes, concert halls, pastry shops, department stores and all wholesale houses, stores, and factories where foodstuffs, medicines, beverages, provisions, merchandise, or services are sold or offered, advertised, or displayed for sale to the public; parks, stadiums and every other place of amusement and recreation; elevators, dining rooms, hotels, eating houses, inns, theatres, athletic fields, gymnasiums, places where sporting events or competitions are held, and any other place where merchandise, services, or amusements are offered to the public.
- ⑶ The phrase “public transportation”, shall include, among others, airships, ships, boats, hearses, busses, railroads, automobiles, cars, carriages, and any other vehicle offering transportation to the public for pay.
Section 7.—This Act shall be known as the “Civil Rights Act of Puerto Rico.”
Section 8.—If any clause, paragraph, section or part of this Act is declared unconstitutional by a court of competent jurisdiction, the said decision shall not affect, impair, or invalidate the rest of this Act, but its effect shall be limited to the clause, paragraph, section, or part hereof so declared unconstitutional.
[ 409 ]Section 9.—All laws or parts of laws in conflict herewith are hereby repealed.
Section 10.—This Act shall take effect ninety days after its approval.

Para determinar el derecho al disfrute por todas las personas de las facilidades que ofrezcan los sitios y negocios publicos en Puerto Rico; disponiendo la cancelacion de contratos de arrendamiento, cesiones, licencias, franqicias efectuados con u otoroados por los gobiernos insular, municipal o por sus agencias, a aquellas personas que violen esta ley; fijando las penalidades por su violacion, y para otros fines.
Exposición de Motivos
El mantenimiento del principio democrático estatuído en la Declaración de Independencia de los Estados Unidos de América, que declara: “Sostenemos como verdades evidentes que todos los hombres son creados iguales”, demands que la Legislatura de Puerto Rico promulgue un estatuto que determine expresamente ciertos derechos civiles fundamentales respecto al disfrute por todas las personas en general de las facilidades que ofrezcan los sitios y negocios públicos de Puerto Rico, que proteja y garantice iguales derechos para todas las personas en Puerto Rico, y el máximo goce de los beneficios que deriven por su condición como tales los ciudadanos o residentes de Puerto Rico, irrespectivamente de diferencias de razas, credo político o religioso, para así propender y estimular:
- El desarrollo y afincamiento en el pueblo de Puerto Rico de los principios básicos de una democracia funcional;
- La destrucción de las prácticas nazifascistas de odios raciales y atropellos contra grupos minoritarios; y [ 406 ]
- El desarrollo de la mejor armonía entre todos los residentes de Puerto Rico, y el sentido de la unidad nacional en nuestra Isla.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.—(a) En Puerto Rico no se negará a persona alguna acceso, servicio e igual tratamiento en los sitios y negocios públicos y en los medios de transporte por cuestiones políticas, religiosas, de raza o color o por cualquiera otra razón no aplicable a todas las personas en general.
(b) Será ilegal la publicación, circulación o distribución de toda orden, aviso o anuncio tendiente a impedir, prohibir o desalentar el patrocinio de, o la concurrencia a los sitios y negocios públicos y los medios de transporte, por cuestiones políticas, religiosas, o de raza o color.
Sección 2.—Toda persona que deliberadamente o mediante informes falsos o cualquier subterfugio violare cualquiera de las disposiciones de esta Ley, incurrirá en un delito menos grave (misdemeanor) y será castigado con una multa no menor de veinticinco (25) dólares ni mayor de cien (100) dólares, o con cárcel por un término no mayor de cien (100) días ni menor de diez (10) días, o ambas penas a discreción del tribunal.
Sección 3.—Cuando se determinare judicialmente que cualquiera persona está operando o haciendo negocios bajo arrendamiento, cesión, concesión o contrato con el Gobierno de Puerto Rico, Gobierno Municipal o cualquiera agencia de éstos, ha violado cualquiera de las disposiciones de esta Ley, en el curso de la operación de tales negocios, por más de una vez, tal arrendamiento, cesión, concessión o contrato será inmediatamente cancelado; Disponiéndose, que ningún arrendamiento, cesión, concesión o contrato similar con El Pueblo de Puerto Rico, Gobierno Municipal, o alguna agencia de cualquiera de éstos, le será extendido a dicha persona dentro del año siguiente a dicha cancelación.
Sección 4.—Sera deber del Procurador General dc Puerto Rico, jueces, fiscales y otros funcionarios de las cortes de Puerto Rico y de los miembros de las fuerzas policíacas de la Isla de Puerto Rico cooperar en hacer efectiva la vigencia y observancia de esta Ley. Si cualquier miembro de las fuerzas policíacas, márshal, submárshal, fiscal, o juez, tuviere conoeimiento o información de cualquier violación de las disposiciones de esta Ley, diligentemente investigará y [ 408 ]procurará evidencia de tal violación, y ante la autoridad competente jurará la correspondiente denuncia en contra de las personas que cometieron la violación.
Sección 5.—La Comisión de Servicio Publico de Puerto Rico revocará cualquier franquicia o licencia expedida de acuerdo con las leyes de Puerto Rico cuando se determinare judicialmente que la persona que estuviere haciendo negocios de acuerdo con tal franquicia o liccecia ha violado cualquiera de las disposiciones de esta Ley, en el curso de sus negocios, en más de una ocasión; Disponiéndose, que ninguna franquicia licencia similar le será extendida a tal persona, dentro del año siguiente a dicha revocación.
- Sección 6.—Definiciones.—
- ⑴ Tal como está usado en esta Ley el término “persona” significa individuo, corporación, asociación, razón comercial, “trust” de negocios, o una organización incorporada; incluye además, cualquiera agencia del Gobierno de Puerto Rico v sus oficiales, funcionarios, agentes, empleados y concesionarios.
- ⑵ Las frases “sitio de acomodo público” y “negocio público” , entre otros significarán auditorios, salones de asamblea y otros sitios de reunión pública; barberías, cafés, salones de concierto, confiterías, tiendas de departamentos y todos los almacenes, tiendas y fábricas donde sean vendidos u ofrecidos, anunciados o desplegados para su venta al público alimentos, medicinas, bebidas, provisiones, mercancías o servicios; parques, estadios, y todo otro sitio de diversión y recreo; elevadores, comedores, hoteles, fondas, posadas, teatros, campos atléticos, gimnasios, donde se celebren concursos o competencias de deportes y cualquier otro sitio donde sean ofrecidos al público mercaderías, servicios, o diversión.
- ⑶ La frase “transportación pública” incluirá, entre otros, aeronaves, barcos, botes, coches fúnebres, guaguas, ferrocarriles, automóviles, carros, coches v cualquier otro vehículo que ofrezca, por paga, transportación al público.
Sección 7.—Esta Ley será conocida como la “Ley de Derechos Civiles de Puerto Rico.”
Sección 8.—Si cualquiera cláusula, párrafo, sección o parte de esta Ley fuere declarada anticonstitucional por un tribunal de jurisdicción competente, dicho fallo no afectará, perjudicará o invalidará el resto de la ley, sino que su efecto quedará limitado a la cláusula, párrafo, sección o parte de esta Ley que así hubiere sido declarada anticonstitucional.
[ 410 ]Sección 9.—Toda ley o parte de ley que se oponga a la presente, queda por ésta derogada.
Sección 10.—Esta Ley comenzará a regir a los noventa días después de su aprobación.
