EXECUTIVE ORDER NO. 16 - 2020

MANDATORY WEARING OF FACE MASK IN ALL PUBLIC PLACES WITHIN THE TERRITORIAL JURISDICTION OF SAN GABRIEL, LA UNION

WHEREAS, President Rodrigo R. Duterte issued Presidential Proclamation No. 929 series 2020 declaring the entire country under State of Calamity due to Corona Virus Disases 2019 (COVID – 2019)

WHEREAS, on March 16, 2020, upon declaration of the President, the entire Luzon was put under Enhanced Community Quarantine restricting the movement of the population in response to the rapidly increasing COVID-19 infection in the country,

WHEREAS, Resolution No. 18 of the Inter-Agency Task Force (IATF) for the Management of Emerging Infectious Diseases adopts the policy of mandatory wearing of face mask,

NOW THEREFORE, I, HERMINIGILDO M. VELASCO, MD, MPM, Municipal Mayor, by virtue of the power vested in me by law do hereby order;

SECTION 1. Declaration of Policy. It is the declared policy of the Local Government Unit of San Gabriel to protect the health and safety of its resident by mandating the wearing of face mask at all times in all places, fixed or mobile that are accessible or open to the public as precautionary and safety measures against COVID-19.

SECTION 2. Definition of Terms. For the purpose of this Executive Order the following terms are hereby defined.

a. Face Mask – any reusable or disposable piece of cloth or any breathable material worn over the face to cover the mouth and nose which can serve as protection against possible infection from a disease like COVID19. This shall include surgical mask, N-95 mask, cloth mask like handkerchiefs, face shields or such other protective equipments as stated in Resolution No. 18 of the IATF.

b. Public Places – all places, fixed or mobile that are accessible or open to the public regardless of ownership, it shall include vehicles offering free ride such as buses and vans that ferry individuals such as frontliners to and from home and place of work.

SECTION 3. Penalty

Considering the gravity of the present situation those who violate this order shall be punishable in accordance with the penalties provided under the following;

a. Article 151 of the Revised Penal Code on Resistance and Disobedience to a person in authority, punishable by imprisonment of 1 month and one day to 6 months and a fine not exceeding Php500.00, or

b. Republic Act No. 11332 or the Mandatory Reporting on Notifiable Diseases under Section 9 which prohibits non-cooperation, punishable by
