b. any person to use or operate any motor vehicle so modified or with removed muffler as to cause loud and unnecessary or unreasonable noise including the noise resulting from exhaust, which is clearly audible from nearby properties and unreasonably disturbing to the quiet, comfort or repose of other persons;

c. any person to use or operate any motor vehicle that emits noise higher than 110 dB(A) even if not modified.

The modification of any noise abatement device on any motor vehicle or engine, or the failure to maintain same so that the noise emitted by such vehicle or engine is increased above that emitted by such vehicle as originally manufactured shall be in violation of this section.

Section 3. Definition of Terms. – As used in this Ordinance, the following terms shall be construed as: Decibel – is a unit used to express the magnitude of sound pressure and sound intensity.

dB(A) – the sound pressure level in decibels measured on the “A” scale of a standard sound level meter having characteristics defined by the American National Standards Institute, Publication ANSI s1.4-1971.

Muffler – is a device for reducing the amount of noise emitted by the exhaust of an internal combustion engine.

Modification – is the act or process of changing parts of something the act or process of modifying something; a change in something; as used in this Ordinance, the term “modification” also includes the removal or the tampering of something.

Modified Muffler – is a muffler look-alike but without its silencer component which have been removed or tampered, which result to loud noise of engine.

Motor Vehicle – refers to any vehicle propelled by any power other than muscular power.

Traffic Enforcer - any person or persons duly authorized by the Local Chief Executive to man the smooth flow of traffic within the territorial jurisdiction of the Municipality of Urbiztondo.

Section 4. Lead Office. – The Urbiztondo Philippine National Police (PNP), the duly deputized Traffic Enforcer by the Local Chief Executive, and the barangay officials including barangay tanods within their respective territorial jurisdiction shall be the lead agency in the implementation of this ordinance. However, the apprehended motor vehicle by the barangay official shall be turned over to the PNP for impoundment

The share of the Barangay from the fines mentioned in Section 6 shall be 50% of the corresponding fine and shall be credited quarterly by the Municipal Accountant’s Office to the account of that particular Barangay where the apprehension of violators of this ordinance was made.
