4. Manufacturer — one who produces, imports, traders in and distribution processed foods or food products.

Section 4. Regulations.

1. It is hereby encouraged that every manufacturer, producers, seller/vendor, retailer of fortified foods shall register with the Office of the Municipal Nutritionist.

2. All sellers/vendors/retailers are hereby mandated to make available to customers only fortified food products in their establishments.

3. All food outlets, restaurants and food services are hereby encourage to serve fortified staples and fortified processed products.

4. All manufacturers/processors of food products are hereby required to use fortified foods/staples in the processing of their product and must comply with the provisions of R.A. 8979 and its implementing rules and regulations.

Section 5. Administrative Provision

The Local Chief Executive shall implement this ordinance with the help of the Rural Health Physician and/or Municipal Nutritionist or any similar discharging the same function. For this purpose, they are authorized to conduct periodic unannounced inspection and confiscate any evidence in accordance with law. They are empowered to enlist the assistance of the PNP if deemed necessary.

It is mandated that Non-Government Organization (NGOs), Department of Education (DepEd). Barangay officials that circularize the use of Fortified Food Products, tackle awareness campaign and disseminate information drive.

Section 6. Allocation of Collected Fines. The amount paid as fines shall be collected by the Municipal Government Treasury.

Section 7, Penalty Clause.

Any violation of the provision of this ordinance shall be punishable by fine as follows .

a. 1st offense Phpl ,OOO.OO

b. 2nd offense 1 ,500.oo

C. 3rd offense 2,500.00 fine and the Municipal Mayor shall revoke his/her business license. And shall be allowed to reoperate after proper compliance with this ordinance.

Section 8. Repealing Clause.

All Municipal Ordinance rules and regulations of Municipality which are inconsistent with this ordinance are hereby revoked or repealed.
