Section 5. Penalties. – The motor vehicle of the person violating this Ordinance shall be impounded at the PNP-Headquarters and shall only be release upon payment of corresponding fees as imposed by the court. First Offense – Warning. The driver, the plate number, and registration number of the vehicle shall be recorded in the police blotter.
Second Offense – Fine of Php500.00;
Third Offense – Fine of Php1,000.00;
Fourth Offense – Fine of Php1,500.00
Fifth Offense – Fine of Php2,500 or imprisonment of ten (10) days, or both, at the discretion of the court;
The Motorized Tricycle Operator’s Permit (MTOP) or other permit of public motor vehicles such as tricycles, jeeps or other mode of public transportation within the municipality shall be temporarily suspended pending the restoration of its original muffler.
After serving the corresponding penalty of each offense, the offender of this Ordinance will be given a maximum period of three (3) days to restore, replace, or repair its original muffler.
Any offender apprehended in violation of this Ordinance, shall personally pay the fine imposed herein at the Office of the Municipal Treasurer. Then the offender will present the receipt of payment to the PNP Office to process the release of the offender and the subject vehicle by means of appropriate entries in the police blotter.
Section 6. Separability Clause. – Should any provision of this ordinance be declared by a court of competent jurisdiction to be illegal, unconstitutional or invalid, the other provisions not so affected shall remain valid and effective.
Section 7. Effectivity. – This Ordinance shall take effect within ten (10) days after its approval and publication in a newspaper of local circulation.
