SECTION 1. The Local Government Unit of Balungao, Pangasinan shall strictly enforce “One Lot, One Pantheon” policy at the Old Public Cemetery. Such policy shall cover and therefore declare unlawful the following:
I) Opening of old pantheon for burial purposes.
II) Construction of pantheon on top of existing old one.
III) Construction of more than One (1) pantheon per open lot/space.
SECTION 2.
Exhumation and transfer of cadavers and or remains from the old to the new public cemetery or to any public or private interment facilities, is hereby declared legal; provided, that it must be reported first with the Office of the Municipal Treasury, Municipal Engineering Office, and the Rural Health Unit, for the purpose of complying necessary requirements provided for by existing laws and rules.
SECTION 3. Any person found violating this Ordinance shall be the subject of the following penalties:
i) First Offense……………………….Php 1,000.00
ii) Second Offense…………………….Php 1,500.00
iii) Third Offense…………………….Php 2,000.00 or Three (3) months imprisonment or both at the discretion of the court.
The penal provisions stated above shall also cover government employees found violating this Ordinance, not prejudicing the filing of necessary administrative case/s to any disciplining authority.
SECTION 4.
All Ordinances, or any part or parts thereof, which are inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.
SECTION 5.
If for any reason, any provisions of this Ordinance are declared invalid or unconstitutional, the remaining provisions not affected thereby shall continue to be in full force and effect.
SECTION 6. This Ordinance shall take effect upon its approval.
