This work is the French worded version published between 1900 and 1919, with words by Amédée-Louis Hettich (1856-1937), together with the Neapolitan words by Giovanni Capurro. This work is under the public domain in the US (<1923).
The copyright status of this work has been disputed in Italy. Even if all the commercial copies of 'O sole mio are remarked to contain music by E. di Capua (died in 1917), a lawsuit in Turin (Italy) managed to prove that another young composer, Alfredo Mazzucchi (died in 1972), participated in the creative conception of this song.  The most updated status is that the work will remain under copyright in Italy up to 2042.
This work is in the public domain in the United States because it was first published outside the United States prior to January 1, 1924. Other jurisdictions have other rules. Also note that this work may not be in the public domain in the 9th Circuit if it was published after July 1, 1909, unless the author is known to have died in 1948 or earlier (more than 70 years ago).
This work might not be in the public domain outside the United States and should not be transferred to a Wikisource language subdomain (or as a file it should not be migrated to the Wikimedia Commons) that excludes pre-1924 works copyrighted at home.
